Brexit Changes to Right to Work (RTW)

We are sure you and your teams have been looking at the Brexit changes and how they will impact your business.

ADVANCE have been regularly reviewing Home Office guidance with regards to changes to Right to Work to ensure we have minimal disruption to you and your workers. We will continue to keep you updated when more guidance is provided, please click here for our current update in detail.

FCSA update regarding Right to Work (RTW)

FCSA has just received confirmation that the temporary COVID-19 RTW checks have now been extended until 21st June. An update from BEIS to the FCSA is set out below.

“Further to the Home Office’s announcement on 20 April that the temporary COVID-19 adjustments to the right to work scheme would be coming to an end, the Home Office has decided to push the end date back to 21 June. An update to gov.uk and communications from the Home Office will be published. They have recognised the benefit the adjusted checking process has brought to employers and is also undertaking a review of the value of technology, including identification verification technology (IDVT), in supporting the right to work process going forward.”

The impact of the IR35 changes

We are continuing to see PSCs/limited company contractors move over to either Umbrella or CIS.

In addition, a number of contractors are now being advised by their agency/client whether they are “inside” or “outside” IR35 for their new assignments. This enables the contractors to know their status prior to going ahead with their options. Not surprisingly, there are still certain sectors of contractors who are still digging their heals in with clients & agencies.

Service

Our dedicated Contractor Relations team have expanded their remit to a more proactive approach to contractors impacted by IR35. They are spending time calling contractors reviewing their tax code changes and how this can impact their pension options. In addition, they are reviewing the impact to contractors earning over £100k and the option of completing a tax return, and their obligations with their existing limited company.

ADVANCE are continuously looking at ways to improve our levels of service.

Our business focus is to ensure we are doing the basics each day, this include picking up the phone within 3 rings, paying workers on time & responding to any emails within the same business day. In addition to the basics, we are focusing on contacting workers proactively, on aspects of key information. The feedback we have received from these calls have been very positive so far.
